The following notes provide a simple overview of what happens to your personal data when you visit this website. Personal data is any data with which you can be personally identified. Detailed information on data protection can be found in the privacy policy below this text.
Who is responsible for data collection on this website?
Data processing on this website is carried out by the website operator. Their contact details can be found in the section "Note on the Controller" in this privacy policy.
How do we collect your data?
On the one hand, your data is collected when you provide it to us. This can be, for example, data that you send us by email or enter when booking an appointment or submitting an application.
Other data is collected automatically or with your consent by our IT systems when you visit the website. This is primarily technical data (e.g., internet browser, operating system, or the time the page was accessed). This data is collected automatically as soon as you enter this website.
What do we use your data for?
The data is collected to ensure the error-free provision of the website and to handle the requests you send us. It is not used to analyze your user behavior.
What rights do you have regarding your data?
You have the right at any time to receive information, free of charge, about the origin, recipient, and purpose of your stored personal data. You also have the right to request the rectification or deletion of this data. If you have given consent to data processing, you can revoke this consent at any time for the future. Furthermore, you have the right to request the restriction of processing of your personal data under certain circumstances. You also have the right to lodge a complaint with the competent supervisory authority.
You can contact us at any time regarding this and other questions on the subject of data protection.
This website does not use any web analytics, tracking, profiling, or advertising tools. Your surfing behavior is not statistically evaluated, and no analytics or advertising cookies are set. The website loads no third-party JavaScript.
The third-party services that are embedded, and the data they receive, are listed under "Plugins and Tools" at the end of this privacy policy.
This website is hosted on a dedicated server that we operate ourselves. The server is provided by Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany ("the hosting provider"), and is located in a data centre in Germany. Personal data collected on this website is stored on that server. This may in particular include IP addresses, the addresses of requested pages, and the date and time of a request.
Hosting takes place for the purpose of fulfilling our contracts with potential and existing customers (Art. 6(1)(b) GDPR) and in the interest of a secure, fast, and efficient provision of our online offering by a professional provider (Art. 6(1)(f) GDPR).
The hosting provider processes your data only to the extent necessary to fulfil its performance obligations and follows our instructions in relation to that data.
We have concluded a data processing agreement (Auftragsverarbeitungsvertrag) with the hosting provider as required by Art. 28 GDPR. Under that agreement, the contractually agreed data processing takes place exclusively within the European Union or the European Economic Area; any transfer to a third country would require our prior consent and is not currently the case.
To deliver a page, the web server necessarily processes the requesting IP address together with the requested address, the time of the request, and the information your browser transmits (such as browser type and version, operating system, and referring page). This processing is technically unavoidable and is based on Art. 6(1)(f) GDPR, our legitimate interest in the technically error-free presentation and security of our website.
We do not operate persistent access logging on this website: the web server is not configured to write a per-request access log, and request data is therefore not retained for analysis. Diagnostic and error output produced by the server software is kept only for the short period needed to operate the system securely, is not merged with other data sources, and is not used to identify individual visitors.
The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.
When you use this website, various personal data are collected. Personal data is data with which you can be personally identified. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this happens.
We point out that data transmission on the internet (e.g., when communicating by email) can have security gaps. Complete protection of data against access by third parties is not possible.
The controller responsible for data processing on this website is:
Gemma Analytics GmbH
Chausseestraße 17
10115 Berlin
Fax: +49 (0) 30 221 874 13
Email: data@gemmaanalytics.com
The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of processing personal data (e.g., names, email addresses, etc.).
Unless a more specific storage period has been specified within this privacy policy, your personal data will remain with us until the purpose for data processing no longer applies. If you assert a legitimate request for deletion or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g., retention periods under tax or commercial law); in the latter case, deletion takes place after these reasons no longer apply.
If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR and, if special categories of data pursuant to Art. 9(1) GDPR are processed, on the basis of Art. 9(2)(a) GDPR. In the event of explicit consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR. If you have consented to the storage of cookies or to access to information on your device (e.g., via device fingerprinting), data processing is additionally based on Section 25(1) TDDDG. Consent can be revoked at any time. If your data is required for the performance of a contract or for pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data if this is necessary for compliance with a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing may also be based on our legitimate interests pursuant to Art. 6(1)(f) GDPR. The relevant legal bases in each individual case are explained in the following paragraphs of this privacy policy.
Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The lawfulness of data processing carried out up to the time of revocation remains unaffected by the revocation.
IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT, AT ANY TIME AND ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE, OR DEFENSE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).
IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION PURSUANT TO ART. 21(2) GDPR).
In the event of violations of the GDPR, data subjects have a right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work, or the place of the alleged infringement. The right to lodge a complaint is without prejudice to other administrative or judicial remedies.
You have the right to have data which we process on the basis of your consent or in fulfillment of a contract transmitted to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.
Within the framework of the applicable legal provisions, you have the right at any time to obtain free information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, where applicable, a right to rectification or erasure of this data. You can contact us at any time regarding this and other questions on the subject of personal data.
You have the right to request the restriction of processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:
If you have restricted the processing of your personal data, this data (apart from its storage) may only be processed with your consent or for the establishment, exercise, or defense of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or of a Member State.
Our internet pages use so-called "cookies." Cookies are small data packets that do not cause any damage to your device. They are either stored temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your device. Session cookies are automatically deleted after your visit. Permanent cookies remain stored on your device until you delete them yourself or your web browser carries out an automatic deletion.
Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g., cookies for processing payment services).
Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g., the shopping cart function or the display of videos). Other cookies may be used to analyze user behavior or for advertising purposes.
Cookies that are necessary to carry out the electronic communication process, to provide certain functions requested by you (e.g., for the shopping cart function), or to optimize the website (e.g., cookies to measure the web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR unless another legal basis is specified. The website operator has a legitimate interest in the storage of necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6(1)(a) GDPR and Section 25(1) TDDDG); consent can be revoked at any time.
You can set your browser to inform you about the setting of cookies and allow cookies only in individual cases, to exclude the acceptance of cookies for certain cases or in general, and to activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.
Which cookies and services are used on this website can be found in this privacy policy.
Cookies actually used on this website: none. We set no cookies of our own and no third-party cookies. The only data this website stores on your device is a single local storage entry named gemma-lang, which remembers whether you chose the English or German version of the page. It contains nothing but that language choice, is never transmitted to us or to anyone else, and is stored on the basis of Art. 6(1)(f) GDPR (our legitimate interest in showing you the site in the language you selected). You can delete it at any time via your browser's settings for site data.
This website does not contain a contact form. You can reach us by email, by telephone, or by booking an appointment; the appointment booking runs through a third-party service described under "Plugins and Tools" below.
If you contact us by email, telephone, or fax, your inquiry, including all resulting personal data (name, inquiry), will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.
The processing of this data is based on Art. 6(1)(b) GDPR if your request is related to the performance of a contract or is necessary for carrying out pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective processing of inquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be revoked at any time.
The data you send to us in contact inquiries will remain with us until you ask us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after your request has been fully processed). Mandatory statutory provisions, particularly statutory retention periods, remain unaffected.
The following third-party services are used on this website. Only one of them (Personio) loads automatically when you open the relevant page, which means your IP address is transmitted to that provider without any action on your part. The others are plain links: no data reaches the provider until you click them.
This website uses the "Kanit" and "Caveat" typefaces. The font files are stored on our own server and are delivered from there together with the rest of the page. They are not loaded from Google Fonts or any other external font service, so no connection to a third party is established in order to display text, and your IP address is not transmitted to any font provider. If your browser cannot load the fonts, a standard font from your device is used instead.
Our careers page embeds our job listings from Personio. The provider is Personio SE & Co. KG, Seidlstr. 3, 80335 Munich, Germany. The listings are loaded in an inline frame directly from Personio's servers when you open the page, so your IP address and browser information are transmitted to Personio at that point. Applications submitted through Personio are processed under Personio's own privacy information, which is displayed during the application process.
The integration serves to present our open positions in an up-to-date form and is based on Art. 6(1)(f) GDPR. Further information: https://www.personio.de/datenschutzerklaerung/.
To book a discovery call, we link to the scheduling service Calendly. The provider is Calendly LLC, 271 17th St NW, Atlanta, GA 30363, USA. Calendly is not embedded in this website: no data is transmitted to Calendly until you follow the link. If you then book an appointment, the details you enter there (in particular your name, email address, and the appointment time) are processed by Calendly on our behalf and passed to us.
Use of the service is based on our legitimate interest in a simple way to arrange appointments (Art. 6(1)(f) GDPR) and, once you actively book, on Art. 6(1)(b) GDPR. Further information: https://calendly.com/privacy.
For speculative applications we link to a form hosted on Google Forms. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The form is not embedded in this website: no data is transmitted until you follow the link. The information you enter in the form is stored by Google on our behalf and forwarded to us for the purpose of processing your application.
Processing is based on Art. 6(1)(b) GDPR and Section 26(1) BDSG (initiation of an employment relationship) and, where applicable, on your consent (Art. 6(1)(a) GDPR). Further information: https://policies.google.com/privacy.
This website links to our profiles on LinkedIn and GitHub. These are ordinary links; no data is transmitted to those providers until you click them. Once you do, the privacy policy of the respective provider applies.
